tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. I had a RFE against my I-485 in last week of Nov 07. It was for medical exam, doc forgot to check one box :(
Now the RFE has been replied to and USCIS should hopefully have no further questions on my application. But now the issue is retrogression of EB2 India back to Jan 02 (while I am Jun 03). So does that mean though my application could be cleared by the immigration officer, it will still be put back on shelf because of the retrogression in Dec 07 ?

if you have copy of I-140 , it contains 13 digit receipt number (SRC, WAC etc..).
Enter the number in USCIS case status to find out the latest update on the I-140 file @ https://egov.uscis.gov/cris/Dashboard.do

I think that it is very common to get the EAD card with Finger Prints not available printed. I do not think that you should be worried too much about this.

Yesterday I have opened a SR using the Expedite Processing CSR Option by calling USCIS. Spoke to a good CSR who understood the mistake and opened a SR for correcting the EB classfication and expediting the case (sence USCIS Error is an option for Expediting cases). Lets see what happens with this.
Also have a good contact now in Senators office, I already submitted a inquiry through their office and waiting for response.

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
The 140 approval notice is not required unless this is a post six year transfer/extension.

No, not necessarily in my opinion. She has legal F1 status and that is what you will show on the relevant forms.
I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
Will appreciate if anyone has had similar experience and is willing to share.

Couple of questions folks:
1. Should H1 B Job and GC Job be related? I am going for an H1 B extension based on approved I 140.
2. Can we consider Software Quality engineer on H1B and Software engineer on GC related?
The NAICS occupational codes for
Software Quality Engineer is 541511
Software Engnieer is 541710
Can we consider them related for AC 21 purpose. I so not have the approved labor or I 140.
3. Currently am on H1 which is going to expire next month with my current employer and had my GC filed as a software engineer. I am planning to move over to the client where right now am working as a contractor. I am being offered a position as Software Quality engineer.
Now, do I use the H1 extension and go on to the client or use EAD? If I go onto the client on H1 extension, what happens to the GC process and my EAD?
When I leave the company and if the current employer withdraws the I 140, am I ok?

We don't want to waste our golden years of life waiting for law to change, so we can get EAD or GC to start business here in USA.
I have very good business idea where there is huge potential to make it big. My 6th year H1 expires in Feb 2011. PERM recruitment is going on, but my heart is leaning towards starting the business.
So, we decided to take Entrepreneur Federal Immigration to Canada. We are not yet ready to move to India. My case certainly needs consultation (most likely processing) from Immigration Attorney for Canada.
I was looking at Canadavisa.com, but looking for more options. Can anyone recommend other attorneys?
My business idea doesn't require $500,000 investment to target investor visa in USA.
I was thinking NZ Long Term Business Visa, but first I would like to explore Canada and then consider NZ.
