Hi
my wife has got H1 this year and
she wants to transfer to H4 as she got Ead and she
wants to use EAD .and still we didnt get AP.she wants
to leave to india in jan she dont have stamp in her
passport
if we apply now for the conversion of H1 to H4 can
she leave to india now and can i send that approval
letter to india then she goes to stamping in india.
is it possible. please suggest me

- H1B is good as long as employer-employee relationship is maintained, which in your case should be fine
- You may have issues with 140 approval (Just my opinion, I may be wrong)
- If you are considering H1 transfer, that may have issues as you may not have latest paycheck..

I am working as a software professional, my job is a permanent full time job.
I got a labor certification and 140 is still in the process. I am willing to own a company and buying 100% of its shares(not a listed company). The company is incorporated in the state of Michigan. It is a small business company. I will not be serving the company's operations in regular hours and will not be actively involved in the day to day business. I will not be given any designation in the company.
I have the following questions if I own this company:
1. will this have any effect on my current or future any stages(140/485) of Green Card If I own this company.
2. After I own the company, Can I transfer the company profit funds from company bank account to my personal account.
3. Is it possible to own a company without any designation given.
4. After i own this company, will it be treated as I have 2 jobs.
Thank you so much for you time and reading this post.
Please let me know if anyone has any opinion(s) in this situation.

I have applied I-140 and I-485 on July 2. I think I forgot to attach one experience letters to it. Can I attach it to that I-140 after getting the receipt #? what is the procedure?

Hi all,
I am currently working on an L1 visa. Have been in the US for 1.5 years.
A few weeks ago I wanted to change my job. Now I have an offer and the new employer is trying to sort out the visa.
Unfortunately, the H1B visas are gone for this year, and the employer can't wait until October to get me working in their team, so waiting for the new H1 visas is not an option.
After checking with their immigration attorneys, they now say the only option I have is to request an 'O' visa (they will support me).
'O' visas are available for top sportsmen, actors or scientists. The attorneys say I have a good-enough resume to apply for one (masters degree, published some articles and experience in top companies) but I still think the opportunities are not many, since I think my resume is really good but not outstanding enough for this type of visa.
My question is, how careful do I have to be when letting the company attorney to apply for a 'O' on my behalf? And specially, if the visa is denied is that going to impact my current L1 visa? I don't wanna end up with no visa at all! And also, is that going to be a 'bad record' next time I apply for a visa (probably H1)?
What about the positive case? Can I have the 'O' visa during the 2 weeks I will still work in my current company under an L1 (I have to give my company 2 weeks notice before leaving) before moving jobs?
I can't stop thinking the attorneys want the best for the company, that doesn't mean they want the best for me, so I am worried about the possibility they are applying for the visa on my behalf but not minding possible bad consequences for me if the visa is refused.

Hi, Today my I485 had a LUD and when I check the status it is saying:
Document mailed to applicant.
On October 24, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
I already received everything and went for FP 20 days ago. I missed the appointment and then went the next friday and they took the prints. I was told that I didn't need to reschedule the FP. I had the LUD after the FP date too.
I have seen that someone had this same status but did anyone ever receive nay other document in mail?? IF so what is it???

U.S. Department of Labor has implemented a new integrated online system � known as the iCert Portal � through which employers can submit applications for permanent labor certification, labor condition applications (LCAs) and other applications for immigration-related DOL programs. In addition, the agency will introduce new editions of Form ETA-9089, the PERM labor certification application, and have already introduced Form ETA-9035, the labor condition application. iCert has already replaced the method of LCA filing for H-1B. The new iCert system begins to accept LCAs as of July 1, 2009. Employer and attorneys as the case may be, can still use the old LCA account but cannot submit new LCA. New LCA has to be filed from iCert.
Following are the new changes which has taken place:
- The new LCA requires writing the SOC (ONET/OES) code and the occupation title for the job.
- The new LCA has a section for basis for the visa classification supported by the application. There are the following categories:
a. New employment;
b. Continuation of previously approved employment without change with the same employer;
c. Change in previously approved employment;
d. New concurrent employment;
e. Change of employer;
f. Amended petition.
- One has to indicate the total number of H-1B/H-1B1 (http://www.h1b.biz/lawyer-attorney-1137085.html) non-immigrant workers.
- The new LCA also requires, in the employer information section, to indicate the Trade name/doing business as (DBA), if applicable, the old LCA does not have this requirement.

I am on H1B with this company A for the past 2 years. Suddenly/shockingly, due to some unavoidable circumstances, the company is on verge of financial trouble for a short period of time. In case the company does not get some bridge funds, it will shut off its business for 30 days and all the employees will go on UNPAID vacation for that duration. It is not the termination of services or jobs but a temporary absence until company gets some more fuel in the tank.
I am not sure if this will have any effect on my status or not. Again, its not a termination but a temporary leave (for all the employees) without pay for 30 days.

Once you switched from F1 to H1 your F1 becomes void.
If you can get an approved transfer (don't know form # or name) then you should be good, and don't need another stamp. That is my best "guess".

Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?
