The Comprehensive Immigration Reform bill introduced in the House of Representatives would revamp the existing employment-based (EB) preference system in a number of important ways: 1) Increase in EB Numbers - The number of employment-based green cards would increase from 140,000 per year to 290,000. 2) Recapture � Currently, 140,000 persons are permitted to immigrate to the U.S. each year under the EB preference system. India has expressed its concern to the Chinese government over Beijing issuing visas on a separate sheet of paper to Indian nationals from Jammu and Kashmir instead of stamping them in their passports. Ministry of External Affairs (MEA), India strongly believes this, as a well-thought-out strategy to question the status of its state Jammu and Kashmir. It has been issuing visas stapled to passports to people from Arunachal Pradesh who have traveled to China since 2007.
MEA spokesperson Vishnu Prakash says �We have conveyed our concern to the Chinese government in this regard. It is our considered view and position that there should be no discrimination against visa applicants of Indian nationality on grounds of domicile or ethnicity.�
It�s not clear when the Chinese started issuing visas on a separate sheet of paper to Indian travelers of Kashmir. The matter came to light when immigration authorities at New Delhi International Airport, India turned away Kashmiris carrying the standalone visas, assuming they were fakes. The Chinese embassy however issued letters confirming that it had issued valid visas. The matter was then brought to MEA�s notice, prompting it to take up the issue with Beijing. Immigration authorities have been directed to treat the standalone visas as invalid.
This is just to brought some Immigration development in other parts of world. We strongly belief that both the Asian neighbors will resolve such issues amicably soon.

hi my wife had filed 485 on aug 2nd, we got the receipts aug 23rd monday.

Hi,
I have been in US for last 2 years on L1 B and my L1 expires in Dec 09.I My company has already applied for renewal. I wanted to know is it possible to file Green Card, once my petition is renewed, on my own even if employer is not interested in doing it. I am ready to pay my expenses and get it filed. Just wanted to know if it is possible. I have been with my employer for 4 years.

Occupation Title: Computer Software Enginner
OES Code: 15-1031
New Position: Sales Consultant
For the Sales consultant position the description is much more technical and macthes 50% with whats Computer Software Enginner.
1. What are the immigration steps that need to be considered for the portability(AC21) ?
2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?

Hi All,
I had a question regarding the relationship between the number h1b transfers and green card process. I've heard some people say that if you have transferred H1b to many companies then the green card process will be delayed because USCIS needs to be convinced that you will be continuing with the same employer. Is this true or does it really not matter how many times you change employers it doesn't effect the green card process.
I have already transferred once. I am thinking of transferring one or possible two more times but am just worried about how this will effect the green card application process.

For FP, USCIS takes the address from G325A or from the I485 form. The reason I am asking is because my company is putting their's address in I485. So I am wondering.

Priority Date comes first, and then country limit. Country limit is not respected at the last quarter of each Visa Year (July to Sep).
If you're on EB2, then you're on for approval as soon as everything clears (security check, etc.). If you're on EB3, wait for a while dear. It will not come soon.

I did not have my I-140 notice, so I emailed my attorney and he replied with a copy of the I-140 which had the priority date.

Hi All,
I got RFE on 485(field in Dec 2004) in last month for TB Skin test and employement letter. My PD is not current but INS is processing my application. I am waiting for physical notice from attorney. I have dependent whose AOS is not filed now I can not file due to retrogression.
With July bulletin my PD becomes current I am ready to file AOS to my dependent. Offcourse not sure that once I submitted to attorney how soon he will send to USCIS.
I have question that which one is best option to file dependet's AOS?
Submit dependent's AOS with evidences to RFE ? Means in same cover?
or
Submit dependent's AOS and evidences to RFE separatley?
Please advise.
