I have been in this country close to 11 years, and have PD of Feb 2004 EB3 India, and am thinking if I could apply for EB1 through another company than my employer. I am currently using EAD to work but I recently met someone who got GC through EB1 having started the process in 2008. I am really frustrated with the EB3 progress and have no hope so was thinking of this option. I have Masters with about 13 years of experience. Just wanted to check out if any of you are having similar thoughts and if this is a possible route ?
Also , is Labor substitution still a path or has that been blocked out ?

Hi All,
I have an approved I-140 from an employer X. I-140 was approved 2 years ago. And last year I left X company and took a full time position. Since X is my frined he did not mind leaving his company at that time.
I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.
Now we got into some money issues and he wants to revoke my I-140/I485?
Can he do that?
Please advice.

I-94 determines your status in US and visa stamp is a merely used to enter into US .hence make sure your I-94 is stamped till the expiry date of new I-797 otherwise you would get into issues.

My 485 filled on July 2nd @ NSC Received at 11:11 AM - No check cashed and no info.
140 Approved from TSC last year.
EAD is self-filed later on Aug 14th @ NSC with USPS tracking# proof.
But EAD check cashed today from NSC (LIN#)
It's crazy. What I can say more.

have a couple of quick questions. It would be great if someone could
answer them for me.
(1) Do I need to leave my I-94 card in when I give them my
old passport? Is it OK if I remove it? Do they make a big deal of this?
A. It is OK to remove the i-94
(2) In the online form, what do I choose for the "Service Desired" field?
"Re-issue of passport"?
A. Yes, if you are sending the application within one year of your old passports expiry.

I think I found it. For the property you are wishing to limit the range of values to, set the NumberRangesAttribute defined in Microsoft.Windows.Design.Interaction DLL.

My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

If you are going to apply during april 2010 you will need to wait till oct 2010.
You will be ideally getting for remaining 2 years. Thats how i got mine.

I think even if employer revokes or cancels and if you have approval copy of I-140 you can port the date. Please consult some good immigration attorney.

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

Can someone tell me how to get to the button battery that runs the date/clock on a D70? I've had three cameras with the problem of having to reset the date because the clock battery was low and the screen flashes 0 on the frame counter, the camera is virtually disabled. We have had these cameras since the fall of 2004 and they all crashed within a week of each other. I read in the book that the clock battery feeds off of the battery pack, or can be charged up (three days) with the optional ac adapter.
Also we had a problem with dust on the circuitry, dark spots showing up on images, and I had to send it to Nikon. If I need to clean that again in the future, I don't want to fry the circuitry, so any advice about that is greatly welcomed. Thank you

Can you at least produce the extension receipt at the embassy? Is your job title IT Consultant? If the answers are no and yes, personally I would not risk it. Of course this is nothing more than a personal opinion. My H-1B expires in April. I waited for the past 3 months and got my extension approved so I'm going back to China this month.
