Hello Experts,
Little bit of background. I have been working on h1 since 2003 and applied labor in Mar 2005.
I have was able to get my application with 2007 filers. Got my 140 approved last year and ead and FP done as well. My GC sponsoring company is a desi consultancy, which is helpful to a certain extent and I have been with them since 2004.
I am in a bit of a dilemma now. The client, where I have been working for last few years, have instated a new policy in which contractors must be on W2 with the vendors. Vendor I am working with is not big and like any other consultancy (Tek, comsys), will fire if you don't have a project for 15-20 days. In the past, I wouldn't have bothered even thinking about this and moved on for another project but because of recession and difficult job market and I am contemplating this move.
After doing research, I am thinking of the following strategy.
I will transfer my h1b with the vendor and will not use EAD. Plan to work with the vendor for as long as possible and when the contract ends move back with the GC sponsoring employer. I am going with assumption that the GC sponsor will not revoke my 140 (even though it shouldn't matter as I am past 180 days with 485 and 140 is approved) and when the contract ends I have something to fall back on to. Doing that could secure me if USCIS asks EVL in future and I can simply my GC sponsoring company to show that for future employment. Also, I want to keep h1b as a way to bring my wife (if and when, with divine intervention, I get married somehow).
Do you think if this is a viable solution? Any suggestion is welcome.

Sometimes, there are no words to describe someone's insensitivity. You just have to let them express it themselves. So, I give you the words of Reprsentative Steve King (R. Iowa), explaiing why TPS for Haitians is not necessary:
Illegal immigrants from Haiti have no reason to fear deportation, but if they
are deported, Haiti is in great need of relief workers and many of them could be

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.

My wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

Yes - as long as your 485 is pending and you have a US address to receive the card.
So in this case, the person should send the documents from India, correct? One of the requirement was I-94 card. How will we provide that if you are out of the country? What to say for Last Entry?

When you reach NSC or TSC, you talk to an IO. Who really is an IO? Are they first line of customer service at the centers? They then send requests etc to officers handling your cases?

I just finished an intership with a company that does essentially what you do, except that they are already established in the Philadelphia Area. I don't know much, but I think your best bet would be to contact local businesses that might need multimedia stuff. Also, put some time into making a really /really/ kickass site, being as it is what is selling your services.

e)Applied MTR and it was approved in NOVEMBER 2008 and 485 reopened.
f)Applied AP & EAD renewal ,got a EAD card September 2010
g) Since EAD extension got delayed I have applied H1-B Renewal August 1st week of 2010 and got a RFE now asking for proof how beneficiary qualify to extend beyond six years?

AFM Sec. 20.2(c) ��

I dont think there is any way you can apply for GC right now. Once your parents are US citizens they can apply GC for you under family based immigration. Else you need to find an employer (once you get a job) to file GC for you under employment based quota. I am not sure about this but since GC is for future employment can an employer file GC for you based on assumption that once GC is approved you can join him? (in theory it looks possible but I dont think any one has done it. You can consult a lawyer) . But before that you need to find an employer who is willing to file an GC for future employment which is pretty unlikely. So I think you can wait and finish your studies and then see which option suits you better family based or employment based GC.

She can use her AP to enter back but if she has the time and can get h1b stamped she is strongly recommended to do so. Reason behind it is if she has any over stay (out of status) in the past it won't be a problem when 485 is being processed.
In simple terms if you can get visa stamped recommended if not AP is fine. regardless she will be on adjustment of status and also H1B status (have approval notice) at the same time.

We are going to India in dec. By that time we should get our AP. My question is does my wife need to go for H1 stamp or can she enter using her AP and keep H1 status. Both of us have different employers. Her 485 will be filed as my dependant.

AFAIK, everybody needs to fill out form I-9.

I'm going to use EAD under 1099 as an independent contractor, My employer asked me to fill only w-9 form when i joined the company.
My employer doesnt know whether i should fill I-9 form (employment verification eligibility) or not?
Anybody have such experiences to share?

1. You dont need to extend I94. The pending 485 petition keeps you in legal status. You can keep working based on EAD.

With the D100 now carrying a street price of $1499 from legitimate dealers...things are looking mighty nice as the price of admission for quality gear keeps going down.
